What a dink. Under Minnesota law he could be facing charges as if the replica was an actual firearm, correct?

Pretty cut and dried.

The charges will treat the situation as if it were a real gun. Given he's 18, he'll likely be charged as an adult, so he could face some jail time.

We should keep an eye on Edina for any city ordinances about Airsoft. I haven't checked, so I don't know if they already have something on the books.

Section 1000 - Crimes and Forbidden Conduct


1000.03 Discharge of Firearms Prohibited Without a Permit. No person shall fire, discharge, or explode any rifle, gun, pistol, air rifle, BB Gun, pellet gun, paint pellet gun, or other weapon in any part of the City without a permit from the Council. No person shall possess out of doors or transport any of the above listed weapons unless the same is unloaded and cased. The permit shall be in writing and shall be issued by the Council in its discretion upon application to it. Nothing shall be construed to prohibit any firing of a rifle, gun, pistol, or other weapon when done in the lawful defense of person, or property or in the necessary defense or enforcement of the laws.

That pretty much follows the League of Minnesota Cities model firearms code.

It's a safe assumption, based on the LMC model code, that discharge of an Airsoft gun is illegal in almost every municipality in the state, definitely in the Metro agrea.

June 3rd was a little vauge.

Police have arrested an Edina High School student for allegedly pointing a Beretta replica BB gun at another student during an argument in the school parking lot after school on Monday.

June 4th the story is updated after the police search to include that the gun was .177 cal.

During a search by police, Minn's father retrieved a bag that matched the description given by witnesses and gave it to officers. Inside was a .177 Beretta BB gun.
